These terms, together with our Privacy Policy and Cookies Policy, form the agreement between you and us. If any provision is found unenforceable, the rest continues to apply.
We may amend these terms; the version in force is the one published on this page when you send your order request.
How an order is made
This website does not take payment. The process is deliberately simple:
- You add pieces to your bag and send an order request with your name, email address and phone number.
- That request is an offer to buy. It does not create a contract by itself, and our automatic acknowledgement is not an acceptance.
- We check the goods are physically in stock and reply by email with the pieces, sizes, final price, delivery cost and payment details.
- A contract is formed only when we send that written confirmation. If we cannot fulfil the request, we tell you and nothing is owed.
We may decline an order where the item is no longer in stock, where a price or description was clearly wrong, or where we cannot deliver to your address. Where you have already paid, we refund in full.
Prices and payment
Prices are shown in euro (EUR) and include Bulgarian VAT where it applies. Delivery is charged separately and shown before you confirm: it is free on orders over €120 and otherwise €6.90 within the European Union.
Payment is made by bank transfer to the account given in our confirmation email, unless we agree otherwise in writing. Goods are dispatched once payment has cleared and remain our property until paid for in full.
We correct pricing errors as soon as we find them. If the correct price is higher than the one shown, we contact you before proceeding and you are free to cancel.
Delivery
We dispatch from Sofia, Bulgaria within 48 working hours of cleared payment. Delivery within the European Union usually takes 3–7 working days, and we send a tracking reference when the parcel leaves us.
Risk in the goods passes to you on delivery. If a parcel arrives damaged, tell us within 48 hours with photographs and we will resolve it at our cost. If delivery has not happened within 30 days of confirmation, you may cancel and receive a full refund.
We currently ship only within the EU. Any local charge that applies at your end is your responsibility, though within the EU none should arise on goods sold from Bulgaria.
Right of withdrawal and returns
If you are a consumer in the European Union you have a right to withdraw from the contract within 14 days of the day you, or a person you name, take physical possession of the goods. You do not have to give a reason.
To withdraw, tell us clearly before the 14 days end — an email to nikoeurocommerce@inbox.eu is enough. You then have a further 14 days to send the goods back.
- We refund everything you paid, including standard outbound delivery, within 14 days of receiving the goods back or proof that you sent them.
- We refund by the same means you paid, at no charge to you.
- You bear the direct cost of returning the goods unless the item was faulty or wrongly sent.
- You may handle goods as you would in a shop. If you reduce their value by going beyond that, we may deduct the difference.
Beyond this legal right, we accept returns of unworn pieces in their original condition within 14 days of delivery, on the same terms.
Conformity and guarantees
We supply goods that match their description, are of satisfactory quality and are fit for purpose, as required by Directive (EU) 2019/771 and Bulgarian consumer protection law. You have a statutory guarantee of two years from delivery in respect of any lack of conformity.
Where goods are faulty you may ask for repair or replacement and, where that is impossible or disproportionate, a price reduction or termination with a refund. These rights are free of charge and are not affected by anything in these terms.
Natural variation in dyeing, weave and shearling pile, and the fading of garment-dyed and raw denim pieces over time, are properties of the material rather than faults. We describe them on the relevant product page.
Using this website
You may use this site for lawful personal purposes. You may not copy, scrape or republish its text, photographs or code without our written permission; all of it belongs to DALPESH EOOD or our licensors.
We work to keep descriptions and photographs accurate, but colour reproduction varies between screens, and measurements carry normal manufacturing tolerance. We do not warrant that the site will be uninterrupted or error-free, and we may change or withdraw any part of it.
Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be limited — including your statutory rights as a consumer.
Subject to that, our total liability arising out of any order is limited to the price you paid for the goods concerned, and we are not liable for loss of profit, loss of business or any indirect or consequential loss.
We are not liable for failure or delay caused by events beyond our reasonable control, including strikes, carrier failure, extreme weather or the acts of public authorities.
Complaints, governing law and disputes
If something has gone wrong, write to nikoeurocommerce@inbox.eu or call +421 952 669 184. We acknowledge every complaint within 5 working days and aim to resolve it within 30 days.
These terms are governed by the law of the Republic of Bulgaria. If you are a consumer, you also keep the protection of the mandatory rules of the country in which you live, and you may bring proceedings in your own courts.
Consumers in the EU may also use the European Commission's online dispute resolution platform, or refer the matter to the Bulgarian Commission for Consumer Protection, 4A Slaveykov Square, floors 3, 4 and 6, Sofia 1000.
